Terms of Service

Welcome to AI Adult Generator (the "Service"), operated by AI Adult Generator ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, located at www.aiadultgenerator.com, and the services provided therein.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Eligibility and Content Warning

You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher, to access or use the Service. By using the Service, you represent and warrant that you meet this age requirement.

The Service generates content of an adult nature using artificial intelligence. This content may be explicit, offensive to some users, or inaccurate. You acknowledge and agree to access this content at your own risk and discretion. We are not liable for any content generated or your reaction to it.

2. Description of Service

The Service allows registered users to generate artificial intelligence (AI) based images, primarily of an adult nature, using text prompts and other parameters. The Service operates on a credit-based system, detailed further in Section 6.

3. User Accounts

To use the image generation features, you must register for an account, currently via Google OAuth. You agree to provide accurate information during registration. You are responsible for maintaining the confidentiality of your account access and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without notice or liability.

Upon registration, new users may receive a one-time grant of free promotional credits, subject to change or withdrawal at our discretion.

4. User Conduct and Responsibilities

You agree not to use the Service to:

  • Generate, display, or distribute content that is illegal, depicts non-consensual sexual content (including content involving minors, which is strictly forbidden), promotes violence, harassment, hate speech, or exploits, abuses, or endangers minors in any way.
  • Generate, display, or distribute content that impersonates or creates a likeness of identifiable real individuals (including but not limited to celebrities or public figures) without their explicit, verifiable consent, particularly in an explicit or derogatory manner. Creating "deepfakes" or unauthorized likenesses is strictly prohibited.
  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service.
  • Scrape, data mine, reverse engineer, or interfere with the proper working of the Service or any security measures.
  • Use the generated content for any commercial purpose not explicitly permitted or for any purpose that is harmful, defamatory, obscene, or otherwise objectionable.

You are solely responsible for the prompts you provide and the way you use the content generated by the Service. You understand that AI generation can be unpredictable, and you accept responsibility for the output.

5. Content Ownership and Licenses

Your Prompts: You retain ownership of the text prompts and parameters you input into the Service.

Generated Images: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, worldwide license to use, reproduce, display, and distribute the specific images generated by you through the Service ("Generated Content") for personal, non-commercial use, unless otherwise permitted by your subscription plan (if applicable).

You acknowledge that due to the nature of AI, similar or identical images may be generated for other users using similar prompts. You do not obtain exclusive rights to any Generated Content.

We (and our licensors, e.g., the AI model providers) retain all rights in and to the underlying AI models, algorithms, and the Service itself. You obtain no ownership rights in the AI models or the Service.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your Generated Content solely for the purposes of operating, promoting, and improving the Service (e.g., displaying images on the public gallery, training AI models). If you make Generated Content private (where such functionality exists), we will strive to limit its use accordingly, but caching or public display prior to marking as private may occur.

User Responsibility for Use: You are solely responsible for ensuring that your use of the Generated Content does not infringe upon any third-party rights (including copyright, trademark, privacy, or publicity rights) or violate any laws. The generation of an image does not imply that its use is legally permissible in all contexts. Generating an image resembling a specific, identifiable real person without consent does not grant you the right to use that likeness, especially for commercial or public distribution.

6. Credits, Subscriptions, and Payments

Credits: Image generation requires credits. Credits are consumed upon initiating a generation request. Free promotional credits may be granted upon signup. Additional credits can be obtained through paid subscription plans.

Subscriptions: We offer monthly and yearly subscription plans ("Plans") which grant a specified number of credits per billing period. Plan details, including credit amounts and pricing, are available on our "Upgrade" page and are subject to change.

Payments: Payments for Plans are processed through our third-party payment processor, Stripe. By subscribing, you agree to Stripe's terms and conditions. You must provide valid payment information. Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless cancelled.

Yearly Plan Credits: For yearly plans, the full allotment of credits for the entire year is typically granted upon successful payment or renewal. Monthly plans receive credits each month upon successful renewal payment.

Cancellation: You may cancel your subscription at any time through your profile settings. Cancellations are effective at the end of the current billing period. You will retain access to credits and features until the end of the paid period.

Refunds: Payments for subscriptions and credits are generally non-refundable, except where required by law. Unused credits expire upon cancellation or termination of your account. We do not offer refunds for partial subscription periods or unused credits.

Price Changes: We reserve the right to change the price of Plans or the amount of credits granted. We will provide reasonable notice of any price changes before they take effect.

7. Intellectual Property Rights

The Service and its original content (excluding Generated Content licensed to you under Section 5), features, and functionality are and will remain the exclusive property of AI Adult Generator and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

8. Disclaimers

THE SERVICE AND GENERATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE GENERATED CONTENT WILL BE ACCURATE, RELIABLE, MEET YOUR REQUIREMENTS, OR BE FREE OF HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR EXPECTATIONS.

THE AI MODELS USED CAN PRODUCE UNEXPECTED, INACCURATE, OR OFFENSIVE OUTPUTS. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

IN NO EVENT SHALL AI Adult Generator, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING GENERATED CONTENT; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Indemnification

You agree to defend, indemnify, and hold harmless AI Adult Generator and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account; b) a breach of these Terms, or c) Content posted or generated via your account, including any claim that your prompts or your use of Generated Content infringes or violates any third-party right or applicable law.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service and cancel any active subscriptions. Certain provisions of these Terms will survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
